Graphic Images Consisting Mostly of Embedded Words
What to Register:
The Graphic Image or Plain Text Words?
There are Two Choices of What to Register
- GRAPHIC IMAGE (with or without words embedded in the image)
- WORDS ALONE (with no graphical attributes)
Registering a Graphic Image Provides Only Limited Protection:
- Only the specific graphic image itself would be protected and not necessarily any embedded words when those words were used separately from the image.
Words Alone Trademarks Have Advantages:
- Registering a trademark that consisted of words alone (without any graphical attributes) allows the owner of the trademark to stop someone else from using those words (to sell similar goods or services) no matter how those words are displayed.
Two Separate Applications Might be Best to Fully Protect
Words Embedded Within a Graphic
- If a graphic has words embedded within it and you want to protect those words when they are used by someone separate and apart from that specific graphic it might be advisable to file two separate applications, one for the graphic and the other for the words alone
